REVISED ORDINANCE A

(Planning Board Recommendation)

 

AN ORDINANCE AMENDING THE CHAPEL HILL LAND USE MANAGEMENT ORDINANCE ALLOWING CHANGEABLE AND MOVEABLE SIGNS IN PARTICULAR SITUATIONS (2006-09-11/O-4a)

 

WHEREAS, the Council of the Town of Chapel Hill has considered the proposed text amendment to the Land Use Management Ordinance regarding moveable or changeable signs outside the Town Center zoning districts and finds that the amendment is warranted in order to achieve the purposes of the Comprehensive Plan;

 

NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:

 

Section 1. Subparagraph (l) of Subsection 5.14.3 of the Chapel Hill Land Use Management Ordinance is hereby revised to read as follows:

 

“(l) Signs in the Neighborhood Commercial, Community Commercial, and Town Center 1 and -2, and Mixed Use districts that are no more than six (6) square feet in area per display surface. This provision applies only to changeable or moveable signs that are:

 

(1)    limited to one (1) sign per business;

(2)    located in front of the business identified on the sign;

(3)    located on a street with sidewalks on both sides, for those areas outside the Town Center zoning districts;

(4)   adjacent to roadways only if speed limits are at 25 mph or lower, where pedestrian movement is not restricted; and

(5)    displayed only during business hours.

 

Changeable or moveable signs are those non-illuminated signs that change or are moved on a daily basis.”

 

Section 2.  That all ordinances and portions of ordinances in conflict herewith are hereby repealed.

 

Section 3. That the amendments shall become effective upon enactment.
