(Petitioners’ Request)

 

AN ORDINANCE AMENDING THE CHAPEL HILL LAND USE MANAGEMENT ORDINANCE ALLOWING CHANGEABLE AND MOVEABLE SIGNS IN PARTICULAR SITUATIONS (2006-09-11/O-4b)

 

WHEREAS, the Council of the Town of Chapel Hill has considered the proposed text amendment to the Land Use Management Ordinance regarding moveable or changeable signs outside the Town Center zoning districts and finds that the amendment is warranted in order to achieve the purposes of the Comprehensive Plan;

 

NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:

 

Section 1. Subsection 5.14.13 of the Land Use Management Ordinance is hereby established to read as follows:

 

“5.14.13 Changeable/Moveable Signs in NC and CC Zoning Districts

(a) Changeable/Moveable signs are allowed in the Neighborhood Commercial and Community Commercial zoning districts provided the signs are:

(1) No more than six (6) square feet in area per display surface;

(2) Limited to one (1) sign per business, located in front of the business identified on the sign;

(3) Located in areas where speed limits are 35 mph or lower;

(4) Permitted annually by the Town Planning Department;

(5) Displayed during business hours only; and

(6) Not displayed on the public right-of-way unless the business owner receives an encroachment agreement from the Town or the North Carolina Department of Transportation, whichever is applicable, indemnifying the government body from responsibility resulting from injury related to the signage.”

 

Section 2.  That all ordinances and portions of ordinances in conflict herewith are hereby repealed.

 

Section 3. That the amendments shall become effective upon enactment.
