(Approving Application)

A RESOLUTION APPROVING A SPECIAL USE PERMIT APPLICATION FOR THE CASTALIA AT MEADOWMONT (FILE NO. PIN 9798-54-6749) (2006-10-09/R-16e)

BE IT RESOLVED by the Council of the Town of Chapel Hill that it finds that the Special Use Permit application for the Castalia at Meadowmont, proposed by the Castalia Group, LLC, on property identified as Chapel Hill PIN 9798-54-6749, if developed according to the plans dated April 1, 2005 (revised September 9, 2005, February 6, 2006, March 30, 2006, and June 13, 2006), the Meadowmont Master Land Use Plan, and the conditions listed below, would:

  1. Comply with all required regulations and standards of the Land Use Management Ordinance, including all applicable provisions, and with all other applicable regulations, with the modifications listed below.

BE IT FURTHER RESOLVED that the Town Council hereby approves the application for a Special Use Permit for a Castalia at Meadowmont in accordance with the plans listed above and with the conditions listed below:

  1. Resolution A: That all of the stipulations in Resolution A shall apply to the proposed development unless modified or superseded by those stipulations below.
  2. Deleted Stipulations:  That the below stipulations shall be deleted from the Resolution:

    Pedestrian Circulation Plan:  That a pedestrian circulation plan indicating pedestrian access and connection to the street be reviewed and approved by the Town Manager prior to issuance of a Zoning Compliance Permit.

    Parking Lot lighting: That all parking lot lighting shall be designed to use the best possible technology within reason to avoid spray light to adjacent properties approval.

    Provision of Affordable Housing: That the applicant shall provide a payment-in-lieu for $150,000 to the Town’s Revolving Acquisition Fund prior to issuance of the Zoning Compliance Permit.

    Transit:  That the Town Manager review and approve provision for a bus shelter and improving pedestrian access to bus stops prior to issuance of a Zoning Compliance Permit.

    Parking Lot Materials:  That the design of the parking areas shall use porous pavement for the parking areas, if reasonably possible.  Parking lot surface materials shall be reviewed and approved by the Town Manager prior to issuance of a Zoning Compliance Permit.

    Parking Spaces:  That the number of parking spaces be limited to 171 parking spaces.

  3. Added Stipulation:  That the below stipulation shall be added to the Resolution:

    Affordable Housing:  That the developer reserve no fewer than two affordable units. That the developer submits dimensioned floor plans, signed and sealed by an architect, for the residential portion of the development.  That the floor plans shall identify the affordable units. The affordable housing component of this project shall be provided in accordance with the following conditions:

    1.  The affordable units shall be for private ownership.  That the affordable units shall only be available for private ownership and occupancy.
    2. That the affordable units shall be priced so as to be affordable for Qualified Buyers.  Qualified Buyers shall be defined as individuals or families with gross incomes equal to 80% or less of the median income for the Raleigh-Durham-Chapel Hill Metropolitan Statistical Area (MSA), as provided by the U.S. Department of Housing and Urban Development (HUD).
    3. Each Qualified Buyer shall deliver to the Developer written evidence, acknowledged in writing by the Orange Community Housing Corporation (or alternative organization as approved by the Town Manager), that such buyer has been officially determined to be a Qualified Buyer.
    4. That mechanisms shall be established to guarantee that the affordable units shall be permanently affordable and available to Qualified Buyers, subject to the approval of the Town Manager and the Orange Community Housing Corporation (or alternative organization as approved by the Town Manager), prior to the issuance of a Zoning Compliance permit.
    5. That the affordable units shall be constructed and available for occupancy, prior to issuance of the first Certificate of Occupancy for the building. 

BE IT FURTHER RESOLVED by the Council of the Town of Chapel Hill that the Council hereby approves the application for a Special Use Permit for Castalia at Meadowmont in accordance with the plans and conditions listed above.
