ORDINANCE

(Rezoning to TC-3-C zoning)

 

AN ORDINANCE AMENDING THE CHAPEL HILL ZONING ATLAS FOR THE DOWNTOWN ECONOMIC DEVELOPMENT INITIATIVE – PARKING LOT FIVE DEVELOPMENT (Orange County Parcel Identifier Numbers 9788-27-3068, 9788-27-6139, 9788-27-7042, 9788-27-7101, 9788-27-7251, 9788-27-8102, and 9788-27-8107) (2007-06-27/O-10)

 

WHEREAS, the Council of the Town of Chapel Hill has considered the application of Ram Development Company, to amend the Zoning Atlas to rezone property described below from Town Center-2 (TC-2) to Town Center-3-Conditional (TC-3-C) zoning, and finds that the amendment is warranted, because of changed conditions, including Town creation of Northside Neighborhood Conservation District, Town investment in public transit, increasing town-wide traffic issues, increased interest in living in urban core areas, the global energy crisis, global warming, and the potential decline of global petroleum resources (i.e. peak oil), and; is warranted in order to achieve the purposes of the Comprehensive Plan by encouraging walking and bicycling, and reducing automobile travel, and, redeveloping an under-utilized opportunity area;

 

NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill that the Chapel Hill Zoning Atlas be amended as follows:

 

SECTION I

 

That the site, identified as Orange County Parcel Identifier Numbers 9788-27-3068, 9788-27-6139, 9788-27-7042, 9788-27-7101, 9788-27-7251, 9788-27-8102, and 9788-27-8107, that is currently zoned Town Center-2 (TC-2) located between West Franklin and Rosemary Streets with Church Street along the western boundary of the site, including one-half of the abutting rights-of-way of West Franklin Street, Church Street, and West Rosemary Street, shall be rezoned to Town Center-3-Conditional (TC-3-C) zoning. The description of the entire property is as indicated on the attached map and further described as Tracts 700112, 711330, 703231, 729377, 729378, 729379,  as recorded in Orange County Deed Book 499, Page 93 and Tract 706340 as recorded in Orange County Deed Book 499, Page 97.

 

SECTION II

 

That all ordinances and portions of ordinances in conflict herewith are hereby repealed.
