subject: Reschedule of Public Hearings: Aydan Court Zoning Atlas Amendment and Special Use Permit Applications

The Aydan Court applicant, Cazco Inc., has requested that the Council reschedule its public hearings on these two applications to provide the applicant an opportunity to present additional information as regards the Zoning Atlas Amendment application. The applicant may propose a Land Use Management Ordinance Text Amendment and a new zoning district when they return to Council.
The applications affected by this request are as follows:
Zoning Atlas Amendment – Conditional Rezoning: The proposed rezoning application is to rezone a 5.8-acre site from Residential-1 (R-1) to the proposed Residential-Higher Density 2-Conditional (R-HD2-C).
Special Use Permit: The proposed Special Use Permit application is to construct a multi-family development with 58 dwelling units and 122 parking spaces.
I recommend that the Council reschedule the public hearings for the Aydan Court applications.
By rescheduling the public hearings for the Aydan Court applications, the deadline for submittal of a protest petition is also delayed. If a sufficient protest petition is filed with the Town Clerk at least 2 business days prior to the date of the rescheduled public hearing, the proposed rezoning(s) shall not become effective except by favorable vote of not less than three-fourths of the Town Council.
