subject:       Residences at Grove Park, 425 Hillsborough Street: Zoning Atlas Amendment and Special Use Permit Applications

PURPOSE

Tonight the Council continues the Public Hearings regarding applications from RAM Development Company for the Residences at Grove Park Zoning Atlas Amendment and Special Use Permit.  The applicant has requested that consideration of a Zoning Atlas Amendment be delayed to the September 15, 2008 Public Hearing.  The applicant is also requesting that consideration of the Special Use Permit be continued to the Council’s October 13, 2008 business meeting.  The applicant’s request is attached.

The applicant is requesting this delay in order to work with Town staff to amend their proposed Zoning Atlas Amendment application.  The applicant’s rezoning application proposed a zoning district (Residential-Higher Density 2-Conditional) that was not established in the Land Use Management Ordinance.  The applicant is now considering amending their application and requesting that the site be rezoned to the existing Residential-Special Standards-Conditional zoning district.  The applicant is also considering submitting a Text Amendment application to modify the intent and floor area ratios of the Residential-Special Standards-Conditional district.

MAnager’s recommendation

Tonight we believe the applicant will be seeking Council direction and comment with respect to the applicant’s proposal to return with an amended rezoning application and an application to modify the intent and floor area ratios of the existing Residential-Special Standards-Conditional zoning district.

I recommend that the public hearing for the Zoning Atlas Amendment be continued to September 15 and that the public hearing for the Special Use Permit be continued to October  13, 2008, as requested by the applicant:

We also recommend consideration on September 15, 2008 of a text amendment application to amend the intent and floor area ratios of the Residential-Special Standards-Conditional district.  Adoption of the attached Resolution would call for this public hearing.
