A RESOLUTION AUTHORIZING THE USE OF UP TO $60,000 IN STREETSCAPE BOND FUNDS FOR IMPROVEMENTS TO AMBER ALLEY AND THE EXECUTION OF AN AGREEMENT TO ASSURE LONG TERM PUBLIC USE OF THE ALLEY 2008-06-25/R-10)

 

WHEREAS, Amber Alley is a private alley used by the public to access the Town’s Wallace Parking Plaza on Rosemary Street; and,

 

WHEREAS, Amber Alley is in need of certain renovations and repair to improve the public’s ability to use the alley as an access way between Franklin Street and Rosemary Street; and,

 

WHEREAS, adjacent property owners who have an ownership interest in the private Amber Alley have offered to provide the Town with a long term right of use of the alley by the Town and by the public in exchange for the Town’s providing certain funds to make improvements to the surface of the alley; and,

 

WHEREAS, the Council finds that it is in the Town’s and the public’s interest to have those improvements made and that long term right of use established; and,

 

WHEREAS, the Council finds that, because of the proposed long term public use proposed and the specific location and function of this private alley, the use of Streetscape Bond funds to make certain improvements to the alley is appropriate.

 

NOW THEREFORE BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the use of up to $60,000 in Streetscape Bond Funds for improvements to Amber Alley as described in the report of the Town Manager and Town Attorney to the Town Council on June 25, 2008;

 

BE IT FURTHER RESOLVED that the Council authorizes the Town Manager to execute on behalf of the Town the Agreement to provide long term continued public use of Amber Alley substantially in the form as is presented in the June 25, 2008 report to the Council.
