A RESOLUTION  AUTHORIZING THE TOWN MANAGER TO EXECUTE THE NECESSARY DOCUMENT(S) TO GRANT A RIGHT-OF-WAY ON TOWN PROPERTY TO DUKE ENERGY FOR THE INSTALLATION OF PUBLIC UTILITIES ALONG PRESTWICK ROAD AND HAMILTON ROAD(2008-06-25/R-15)

WHEREAS, the Town owns certain land at the corner of Hamilton Road and Prestwick Road, identified by Orange County as PIN 9798340950 also  known as 1003 South Hamilton Road and;

WHEREAS, said Town land  is now used as a Fire Station and adequate area is available  to provide the necessary  vertical and horizontal clearances for the installation and maintenance of utility lines proposed for installation along  the northern right-of-way line of Prestwick Road and along the eastern right-of-way line of Hamilton Road; 

WHEREAS, the grantee shall work with the Town to ensure continuous ingress and egress to the Town property and the affected landscaping on the site shall be restored to pre-construction conditions or better;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council herewith authorizes the Town Manager to execute the necessary documents to grant said right-of-way not to exceed 15 feet from the centerline of electrical facilities to be installed along the street frontage of said Town parcel of land to Duke Energy.
