REVISED RESOLUTION A

(Approving the Master Land Use Plan Modification Application)

 

A RESOLUTION APPROVING AN APPLICATION FOR A MASTER LAND USE PLAN MODIFICATION FOR ST. THOMAS MORE CATHOLIC CHURCH AND SCHOOL (FILE NO. 9798-04-5260) (2008-10-15/R-14a)

 

BE IT RESOLVED by the Council of the Town of Chapel Hill that it finds that St. Thomas More Catholic Church and School Master Land Use Plan Modification proposed by Carlos Lima, representing The Catholic Community of St. Thomas More, on property identified as Orange County Property Identifier Number 9798-04-5260, if developed according to the Master Land Use Plan, dated June 6, 2008, as well as illustrative plan sheet dated July 30, 2008, and the conditions listed below would:

 

1.      Maintain or promote the public health, safety, and general welfare;

 

2.      Maintain or enhance the value of contiguous property, and

 

3.      Conform to the Comprehensive Plan.

 

BE IT FURTHER RESOLVED that the Town Council hereby approves the application for the Master Land Use Plan Modification for the St. Thomas More Catholic Church and School in accordance with the plans listed above and with the conditions listed below:

 

1.      That this Master Land Use Plan Modification shall supersede the Master Land Use Plan that was approved December 4, 1996 by the Chapel Hill Town Council.

 

2.      Master Land Use Plan Expiration: That the Master Land Use Plan shall expire on October 15, 2018.

 

3.      Recorded Master Land Use Plan: That the applicant shall provide a recorded copy of the Town issued Master Land Use Plan Modification, prior to issuance of a Zoning Compliance Permit for the associated Special Use Permit.

 

4.      Land Use Intensity:  That this Master Land Use Plan Modification authorizes:

 

a)      A maximum of 9 buildings.

 

b)      A maximum floor area of 137,405 square feet of institutional floor area for the St. Thomas More Catholic Church and School site;

 

c)      A maximum of 422 parking spaces; and

 

That in a case of conflict between the Land Use Management Ordinance regulations regarding maximum land use intensity and the developer’s proposal; the Land Use Management Ordinance shall supersede the developer’s proposal.

 

BE IT FURTHER RESOLVED that the Town Council hereby approves the application for a Master Land Use Plan Modification for the St. Thomas More Catholic Church and School in accordance with the plans and conditions listed above.
