PURPOSE

The purpose of this report is to propose an adjustment to the schedule for a pending text amendment to the Land Use Management Ordinance regarding demolition of historic structures that would move the public hearing date from April 20 to October 19, 2009.

BACKGROUND

On December 8, 2008 the Council adopted a schedule for pending Land Use Management Ordinance text amendments.  The schedule set a public hearing date of February 16, 2009 for the purpose of considering an amendment to the Land Use Management Ordinance to regulate the demolition of historic structures.

On January 26, 2009, the Council re-scheduled the public hearing from February 16, 2009 to April 20, 2009 due to a staff leave of absence and workload reassignments.

DISCUSSION

 

The Land Use Management Ordinance text amendment regarding the demolition of historic structures was presented to the Historic District Commission on March 12, 2009 and the Planning Board on March 17, 2009.  Both boards raised questions about the proposed text amendment, and the Planning Board indicated a preference to receive the Historic District Commission’s recommendation before moving forward with the Planning Board’s recommendation.  We will return to these boards on May 5, and 19, 2009 to present follow-up information about the proposed text amendment. 

 

In selecting a future public hearing date to present the proposed text amendment, we note that the Council’s May and June 2009 public hearings have been scheduled to receive advisory board and citizen feedback about the proposed Carolina North Development Agreement. 

Therefore, we recommend rescheduling the April 20, 2009 public hearing to October 19, 2009 to allow time for the advisory boards to receive follow-up reports about the proposed text amendment and to keep the May and June public hearings focused on the proposed Carolina North Development Agreement. 

If the public hearing date is rescheduled to October 19, 2009, the Council would be in a position to consider action on the proposed text amendment in November.

RECOMMENDATION

We recommend that the Council adopt the attached resolution which would schedule a public hearing for October 19, 2009 to consider a Land Use Management Ordinance text amendment to regulate the demolition of historic structures.
