Recommendations for Changes to the Recreation Provisions in the Land Use Management Ordinance

The Commission voted unanimously (7-0) to recommend that the Council support the staff’s preliminary recommendations for changes to section 5.5 of the Land Use Management Ordinance, with the following exceptions:

Deletion of Exemption Provision 

The Commission did not support the preliminary staff recommendation to delete the current provision, 5.5.2.(e)(1), that allows the Council to exempt Recreation Area requirements if the required Recreation Area is less than 3,000 square feet. The Commission notes that this provision might be very useful under certain conditions. The Commission recommends that the Council retain the ability to grant an exemption, if warranted, but remove the specific reasons currently listed in order to preserve flexibility.

Change “Concept Plan” to “conceptual plan”

The staff’s preliminary recommended language refers to greenway “Concept Plans” throughout the document. This may be confused with the formal Concept Plan used in the current development review process. We recommend that the words be changed to conceptual plan, in lower case spelling.
