subject:

Public Hearing: Land Use Management Ordinance Text Amendment – Recreation Requirements and Payments in Lieu

date:

April 20, 2009

PURPOSE

Tonight, the Council holds a public hearing to consider proposed Land Use Management Ordinance text amendment changes to consider language amending various sections of Article 5.5 of the Land Use Management Ordinance and related definitions.  Tonight’s public hearing has been scheduled to receive public input about the proposed Land Use Management Ordinance text amendment changes. The purpose of this cover memorandum is to forward my preliminary recommendations to the Council.

MAnager’s preliminary recommendation

I have no preliminary recommendation at this time. We believe the changes proposed could increase Council flexibility and overall general clarity as related to the recreation portion of the Land Use Management Ordinance.   However, input from the public and the Council at the hearing will inform the ultimate recommendation.

I recommend that the Council open the Public Hearing and receive comment about the proposed Land Use Management Ordinance text amendment changes regarding Article 5.5 of the Land Use Management Ordinance and related definitions.  We will return to the Council with a recommendation for action after the Council has received public comment and evidence this evening and reconvened the hearing.
