A RESOLUTION MOVING THE PUBLIC HEARING RELATED TO NON-RESIDENTIAL RECREATION REQUIREMENTS IN THE LAND USE MANAGEMENT ORDINANCE FROM JUNE 15, 2009 UNTIL OCTOBER 19, 2009 (2009-04-20/R-2)

 

WHEREAS, on July 10, 2008, House Bill 2580 was ratified by the North Carolina General Assembly that would allow the Town to make changes to the Town’s Land Use Management Ordinance related to payments in lieu of non-residential Recreation Space; and

 

WHEREAS, in order for the legislation to be effective the Council must modify the Land Use Management Ordinance to require recreation requirements for non-residential development; and

 

WHEREAS, this issue is complicated and requires additional staff time for research purposes;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council reschedules the Public Hearing to consider proposed changes to Article 5.5 related to adding a requirement that non-residential development approved under Special Use Permits be required to provide Recreation Space and/or payments in lieu of Recreation Space from June 15, 2009 to October 19, 2009.
