SUBJECT:       Proposed Parking Restrictions on NC 54 Right-of-Way East of East Barbee Chapel Road

Enacting the attached ordinance would establish “No Parking Anytime” regulations on the right-of-way along the south side of NC 54 east of its intersection with East Barbee Chapel Road.

 

We recommend that the Council enact the attached ordinance.

  

BACKGROUND AND DISCUSSION

 

The Town received numerous complaints that vehicles were regularly parked on the right-of-way along the south side of NC 54 east of East Barbee Chapel Road and in the vicinity of Stancell Road.  Please refer to the attached map (Attachment 1).  Complaints stated that many parked vehicles had “For Sale” signs displayed, and others appeared to be abandoned.  Staff from the Town Inspections Department reviewed the situation and confirmed that approximately 6 to 10 vehicles were often parked for several days at a time, and some displayed “For Sale” signs.  Complaints also expressed concerns about transient traffic slowing and/or stopping along NC 54 to inspect the vehicles for sale. 

 

We determined that the parked vehicles of concern were on the State right-of-way of NC 54 that is not presently regulated by Town ordinances concerning on-street parking.  The State does not allow parking (other than for emergencies) or the sale of vehicles on its rights-of-way.  Town staff advised the adjacent convenience store owner that parking and the sale of vehicles on State rights-of-way was illegal.  We also contacted vehicle owners that had posted telephone numbers on vehicles they intended to sell.  Subsequently, some vehicles were removed, but many remained and the problem continues.

 

In the past, when similar problems have occurred involving State rights-of-way within the Town limits, the State has concurred with the adoption of local regulations and the installation of signs restricting parking on designated segments of State rights-of-way where problems are identified.  We discussed the current situation with the State representatives, and they agreed that parking restrictions on this segment of State right-of-way could be implemented and enforced by the Town.  Enactment of the attached ordinance and associated “No Parking Anytime” regulations would allow the Town to install the necessary signs and to enforce the parking regulations by means of ticketing and/or towing.

 

MANAGER’S RECOMMENDATION

 

That the Council enact the attached ordinance that would establish “No Parking Anytime” regulations on the State right-of-way along the south side of NC 54 east of East Barbee Chapel Road.

AN ORDINANCE AMENDING CHAPTER 21 OF THE TOWN CODE OF ORDINANCES REGARDING ON-STREET PARKING (2004-02-09/O-1)

 

BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:

 

Section 1.  Section 21-27 of the Town Code of Ordinances, “No parking as to particular streets.” is hereby amended by adding the following in appropriate alphabetical order:

Chapel Road                East Barbee Chapel Road

 

Section 2.  This ordinance shall become effective March 1, 2004.
