SUBJECT:       Recessing Public Hearing on Proposed Amendments to the Land Use Management Ordinance

The attached resolution would recess a Public Hearing on the Land Use Management Ordinance, to be reconvened on February 23.

 

BACKGROUND AND DISCUSSION

 

On January 21, the Town Council opened a Public Hearing to consider proposed amendments to the Land Use Management Ordinance.  At the conclusion of discussion, we recommended that we bring some of the items back for consideration and action on February 9, and the balance of items back on February 23.  Accordingly, the Council recessed this Public Hearing, to be reconvened on February 9.   

 

For two reasons, we recommend that all items come back for consideration and possible action on February 23, rather than partial action tonight.  First, the related Northside Neighborhood Conservation District rezoning proposal was recessed to February 23.  The issue of duplex regulations connects these two proposals; if the Land Use Management Ordinance proposals that would allow duplexes (with new restrictions) is enacted before the Northside rezoning (which would prohibit duplexes in Northside), there would be a period of time when duplexes are once again, briefly, permitted uses in Northside.  We do not believe this is consistent with the Council’s intent for treatment of duplexes in Northside. 

 

The second reason is weather-related.  The recent winter storm during the week of January 26 disrupted work in what was already a tight window for preparing some of the Ordinance amendments for return to the Council on February 9.  We have not been able to accomplish the staff work that we thought might be possible.

 

RECOMMENDATION

 

We recommend that the Council reconvene the Public Hearing tonight on proposals to amend the Land Use Management Ordinance, and then recess the hearing until February 23.  Adoption of the attached resolution would do so.

 


 

 

A RESOLUTION RECESSING A PUBLIC HEARING TO CONSIDER AMENDMENTS TO THE LAND USE MANAGEMENT ORDINANCE (2004-02-09/R-7))

 

WHEREAS, the Town Council opened a Public Hearing on January 21, 2004 to consider proposed changes to Chapel Hill’s Land Use Management Ordinance; and

 

WHEREAS, the Council, at the end of discussion on January 21, recessed the Hearing, to be reconvened on February 9, 2004; and

 

WHEREAS, additional time is needed to perform staff work related to the issues under consideration;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council recesses this Public Hearing, to be reconvened at 7:00 pm on February 23, 2004, in the Town Hall Council Chamber.
