subject:Update on Front Yard Parking Enforcement in the area of Old Pittsboro Road and Coolidge Street

The purpose of this report is to present information regarding enforcement of the Land Use Management Ordinance Front Yard Parking regulations along Old Pittsboro Road and Coolidge Street.  As of this writing all properties on these streets are in compliance with front yard parking requirements. 

BACKGROUND

The Land Use Management Ordinance Section 5.9.9 defines and regulates front yard parking; and Section 7.6 mandates that any nonconforming parking area in a front yard shall either be eliminated or made to conform to current regulations within six months of notice of violation.

DISCUSSION

On June 14, 2004, the Town Council received a petition from residents of Coolidge Street requesting that the front yard parking regulations be enforced along Old Pittsboro Road and Coolidge Street. 

The Inspections Department implemented systematic enforcement of the front yard parking regulations to bring the properties along the two roads into compliance.  Inspection requests were received in response to the notices mailed to each property owner and inspections were conducted to determine compliance. 

During the enforcement process property owners were notified when their property did not comply with the front yard parking regulations.  Some owners chose to alter their parking area to comply with the regulations.  A few owners applied to the Town for an exception to the front yard parking area limitation.  Section 5.9.9 of the Land Use Management Ordinance provides for exception to the front yard parking restrictions when environmental constraints preclude parking elsewhere and the following conditions exist on the property:

(1)The parking area is clearly defined and or marked; and

(2)The parking area is maintained in a safe and sanitary condition; and

(3)The parking area does not contribute to soil erosion or tree damage; and

(4)Access to front yard parking shall be limited to properly approved curb cuts or
other approved access points; and

(5)The location and dimension of such parking area is traditionally and customarily
associated with the subject structure; and

(6)If the parking lot is located in the Historic District, the Historic District
Commission grants a Certificate of Appropriateness for the parking area.

There were a total of forty nine (49) parcels identified along Old Pittsboro Road and Coolidge Street.  Forty-three (43) were confirmed to have compliant front yard parking.  Six (6) properties were granted an exception to the maximum parking area regulation as authorized by Section 5.9.9(d) of the Land Use Management Ordinance and are also in compliance.

CONCLUSION

As of this writing the Old Pittsboro Road and Coolidge Street properties are in compliance with the current Land Use Management Ordinance.
