A RESOLUTION TO CLOSE A SECTION OF ROSEMARY STREET RIGHT-OF-WAY

 

WHEREAS, the Council of the Town of Chapel Hill on October 10, 2005, adopted a resolution of intent to consider closing up to a seven foot wide section of the existing 45-foot-wide Rosemary Street right-of-way between S. Columbia Street and Henderson Street, adjacent to the Wallace Parking Deck, and as shown on Orange County Tax Map 7.80A; and

 

WHEREAS, the closing of this section of the Rosemary Street right-of-way would not be contrary to the public interest; and no individual owing property in the vicinity of the right-of-way would be deprived of reasonable means of ingress and egress to his or her property by the closing of said right-of-way;

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby adopts this order pursuant to North Carolina G.S. 160A-299, permanently closing up to a seven foot wide section of the existing public right-of-way on the south side of Rosemary Street (adjacent to the Wallace Parking Deck) located between the intersection of Rosemary Street and Henderson Street and a point approximately 461 feet to the west of said intersection, which shall be shown on a plat to be provided by the party requesting the right-of-way closure and approved by the Chapel Hill Engineering Department.

 

BE IT FURTHER RESOLVED that the said plat along with this Order of Closure shall be recorded by the requesting party, with the Orange County Register, upon approval by the Town.
