SUMMARY MINUTES OF A CLOSED SESSION

OF THE CHAPEL HILL TOWN COUNCIL

MONDAY, APRIL 14, 2003 AT 10:56 P.M.

Mayor Kevin Foy called the closed session to order at 10:56 p.m.

Council members present were Pat Evans, Ed Harrison, Mark Kleinschmidt, Bill Strom, and Jim Ward.

Council members Flicka Bateman, Dorothy Verkerk, and Edith Wiggins were absent, excused.

Staff members present were Town Manager Cal Horton, Assistant Town Managers Sonna Loewenthal and Florentine Miller, Town Attorney Ralph Karpinos, Town Clerk Joyce Smith.

Possible Acquisition of Property Abutting the Site of the

Proposed Town Operations Center

Assistant Town Manager Sonna Loewenthal explained that the staff needed instruction from the Council regarding the possible acquisition of property near the site of the proposed Town Operations Center.  Ms. Loewenthal said staff had contacted Mr. Nunn and Mr. Rogers regarding the Town’s potential purchase of their property, which directly abuts the proposed site.  She said no response has been received from Mr. Nunn to date, but she did receive an affirmative response from Mr. Rogers.  Ms. Loewenthal noted the benefits of purchasing Mr. Rogers’ property, including the additional means of ingress and egress it would provide.

Council Member Harrison asked if there is a chance Mr. Nunn will negotiate.  Ms. Loewenthal said it is possible that he will, noting staff had discovered from his attorney that Mr. Nunn was currently going through bankruptcy proceedings.

Council Member Strom asked if the Town wanted both parcels.  Mr. Horton replied yes.

COUNCIL MEMBER WARD MOVED, SECONDED BY MAYOR PRO TEM EVANS, TO PROCEED WITH ACQUIRING THE ROGERS PROPERTY AT THE PRICE OF $340,000, AND TO PROCEED WITH ATTEMPTS TO ACQUIRE THE NUNN PROPERTY.  THE MOTION WAS ADOPTED UNANIMOUSLY (6-0).

Acquisition of a Pedestrian Easement Near the Intersection

of Elliott Road and Fordham Boulevard

Ms. Loewenthal stated the staff proposed purchasing an easement from Burger King, located on the corner of Elliott Road and Fordham Boulevard, in order to construct a sidewalk.  She noted that the funds for the cost of the easement would come funds set aside for sidewalks.

COUNCIL MEMBER WARD MOVED, SECONDED BY COUNCIL MEMBER STROM, TO PURCHASE THE EASEMENT FROM BURGER KING AT THE PRICE OF $2,000, WITH FUNDS TO BE PAID FROM SIDEWALK FUNDS.  THE MOTION WAS ADOPTED UNANIMOULSY (6-0).
