A RESOLUTION TO CLOSE A SECTION OF HIGHLAND WOODS ROAD RIGHT-OF-WAY
WHEREAS, the Council of the Town of Chapel Hill on November 21, 2005 adopted a resolution of intent to consider closing approximately 165 feet of the existing Highland Woods Road right-of-way; and
WHEREAS, the Council of the Town of Chapel Hill has received a petition for relocation of Highland Woods Road; and
WHEREAS, the Highland Woods neighborhood supports the relocation of Highland Woods Road; and
WHEREAS, the Council, on May 24, 2004 approved a conceptual plan for relocation of Highland Woods Road; and
WHEREAS, the Town has entered a Municipal Agreement with the State to accept State funds for the relocation of Highland Woods Road; and
WHEREAS, the Town received a letter from the University of North Carolina agreeing to dedicate the right-of-way required for the relocation of Highland Woods Road; and
WHEREAS, closing this right-of-way would not be contrary to the public interest, and no individual owning property in the vicinity of the right-of-way would be deprived of reasonable means of ingress and egress to his or her property by closing of said right-of-way;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby adopts this order of closure pursuant to North Carolina G.S. 160A-299, permanently closing a section of Highland Woods Road right-of-way approximately 50 feet wide and 165 feet in length as shown on Orange County Tax Map 7.66 and subject to the reservation of blanket utility and drainage easements which shall be recorded on a plat and approved by the Chapel Hill Engineering Department.
