RESOLUTION A

A RESOLUTION AUTHORIZING THE MANAGER TO EXECUTE A CONSERVATION EASEMENT TO THE BOTANICAL GARDEN FOUNDATION, INC. FOR ABOUT 92 ACRES OF TOWN PROPERTY ALONG MORGAN CREEK (2006-05-22/R-11a)

WHEREAS, the Town of Chapel Hill has acquired approximately 92 acres of open space along Morgan Creek; and

WHEREAS, a portion of the property was purchased using open space bond funds; and

WHEREAS, the Council has determined that it would be in the best interest of the community to preserve the land for its natural values in perpetuity; and

WHEREAS, a mission of the Botanical Garden Foundation, Inc is to preserve land in its natural state;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to execute a conservation easement to the Botanical Garden Foundation, Inc. for 92 acres of Town property along Morgan Creek, known as the Morgan Creek Preserve and identified on the map presented to the Council on May 22, 2006.
