RESOLUTION B

A RESOLUTION AUTHORIZING THE MANAGER TO EXECUTE AN AGREEMENT WITH THE BOTANICAL GARDEN FOUNDATION, INC. TO MONITOR THE MORGAN CREEK PRESERVE AND TO SPEND TOWN FUNDS TO SURVEY AND SIGN THE BOUNDARIES OF THE PRESERVE (2006-05-22/R-11b)

WHEREAS, the Town of Chapel Hill has acquired approximately 92 acres of open space along Morgan Creek; and

WHEREAS, a portion of the property was purchased using open space bond funds; and

WHEREAS, the Council has determined that it would be in the best interest of the community to preserve the land for it natural values in perpetuity; and

WHEREAS, the Council has granted conservation easements to the Botanical Garden Foundation, Inc.;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to execute an agreement with the Botanical Garden Foundation, Inc. to monitor the 92 acres of open space along Morgan Creek, known as the Morgan Creek Preserve substantially consistent with the terms described in the Town Manager’s May 22, 2006, report to the Town Council.

BE IT FURTHER RESOLVED that the Manager is authorized to spend Town funds to survey and sign the boundaries of the Morgan Creek Preserve.
