A RESOLUTION EXTENDING THE BOUNDARIES OF THE DOWNTOWN SERVICE DISTRICT (2006-05-22/R-1a)
WHEREAS, the Council has determined that the area shown as proposed additions to the Downtown Service District in the maps in attachments 1 and 2 and listed in attachment 6 is contiguous to the district, with at least one eighth of the area's aggregate external boundary coincident with the existing boundary of the district; and
WHEREAS, the area to be annexed requires the services of the district; and
WHEREAS, a proposal to change the boundaries of the Downtown Service District was distributed to properties proposed for inclusion in the Downtown Service District on April 24, 2006; and
WHEREAS, the Town Council on April 24, 2006 called a hearing for May 22, 2006 to receive comment on proposed boundary changes for the Downtown Service District; and
WHEREAS, notice of a public hearing was published on May 14, 2006; and
WHEREAS, a report on proposed changes including 1) A map of the service district and the adjacent territory showing the present and proposed boundaries of the district; 2) A statement that the area to be annexed meets the standards and requirements of N.C.G.S. 160A-538(a)(1); and 3) A plan for extending services to the area to be annexed was distributed to the Council and to the proposed affected property owners on May 9, 2006; and
WHEREAS, a public hearing was held on May 22 on the proposed boundary changes;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby extends the boundaries of the Downtown Service District to include the properties shown as proposed additions to the Downtown Service District as shown in the attached maps effective July 1, 2006.
