A RESOLUTION AUTHORIZING THE MANAGER TO EXECUTE A MULTI-JURISDICTIONAL INTERLOCAL AGREEMENT FOR THE ACQUISITION OF 42.83 ACRES OF PROPERTY ADJACENT TO ERWIN ROAD AND LOCATED WITHIN BOTH ORANGE AND DURHAM COUNTIES (2006-06-12/R-8)
WHEREAS, the City of Durham, Orange County, Durham County, the Erwin Area Neighborhood Group, and other agencies have agreed to purchase a 42.83-acre tract of land straddling the Orange-Durham County line and which is referred to as Erwin Trace; and
WHEREAS, the Council believes that the property would best serve the needs of the community as open space or a public park; and
WHEREAS, the Council has pledged $100,000 in Open Space bond funds to be used in a Multi-Jurisdictional purchase of the property; and
WHEREAS, the staff of the City of Durham, Orange County, Durham County, and the Town of Chapel Hill have negotiated a draft agreement to address issues of cost, management, and use of the property;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to execute an Interlocal Agreement for the purchase, management, and use of the 42.83-acre Erwin Trace property in conjunction with the City of Durham, Orange County, and Durham County.
BE IT FURTHER RESOLVED that the Council authorizes a maximum Town contribution of $100,000 to be used for the purchase of a 42.83-acre tract.
BE IT FURTHER RESOLVED that the Town Manager is authorized to negotiate the location and configuration of the Town’s two-acre parcel to be subdivided from land that will be owned by Durham County.
BE IT FURTHER RESOLVED that the authorization is conditioned upon approval by all governmental units party to the agreement.
