RESOLUTION D

A RESOLUTION REFERRING THE APPLICANT TO A SPECIAL USE PERMIT PROCESS FOR AQUABELLA SUBDIVISION (2006-11-06/R-9d)

WHEREAS, the Council of the Town of Chapel Hill has consider a Major Subdivision application for Aquabella Subdivision; and

WHEREAS, the Town Council is interested in pursing the broader stormwater objectives preliminarily identified by the Aquabella Subdivision applicant which are beyond the subdivision approval process; and

WHEREAS, Council Members expressed interest in exploring regulatory options that would permit the applicant to construct the proposed private bio-retention facilities off-site along Pinehurst Drive public right-of-way.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council encourages the Aquabella Subdivision, applicant to consider submitting a Special Use Permit application to further consider the broader stormwater objectives.
