(Bicycle and Pedestrian Advisory Board Recommendation)

(Approving Application)

 

A RESOLUTION APPROVING AN APPLICATION FOR A PRELIMINARY PLAT FOR FAIRWAY HILL SUBDIVISION (File No. 9798-67-4341) (2006-11-20/R-9c)

 

BE IT RESOLVED by the Council of the Town of Chapel Hill that it finds that the Fairway Hill Subdivision, proposed by H. E. Rayfield, Jr., on the property identified as Chapel Hill Township PIN 9798-67-4341, if developed according to the preliminary site plan dated March 8, 2006 and revised July 20, 2006, and the conditions listed below, would comply with the provisions of the Land Use Management Ordinance:

 

BE IT FURTHER RESOLVED that the Town Council hereby approves the application for a Preliminary Plat for Fairway Hill Subdivision in accordance with the plans listed above and with the conditions listed below:

 

1.      Resolution A:  That all of the stipulations in Resolution A shall apply to the proposed development unless modified or superseded by those stipulations below:

 

2.      Deleted Stipulation:  That the below stipulations shall be deleted from the Resolution:

 

New Road Location: That the new subdivision roadway intersects Pinehurst Drive approximately at the location of the existing driveway and shall be located as generally shown on sheet 5 of 12 of the revised site plan dated November 8, 2006. 

 

Pedestrian/Bicycle Path to Meadowmont Soccer Field:  That prior to issuance of the first Certificate of Occupancy, the applicant or Homeowners’ Association shall construct a 5-foot wide pervious surface improved public pedestrian/bicycle path to the Meadowmont Soccer Field.  That the preferred location shall be generally between lots 2 and 3.  That the construction of the path shall involve minimal land disturbance.  That the final location and design of the path shall be approved by the Town Manager prior to issuance of a Zoning Compliance Permit.

 

Alternative Landscape Buffer: That in lieu of providing a 20-foot Type “C” buffer at the Country Club property line, an alternate buffer may provided between the proposed development and the Chapel Hill Country Club.  That an alternate landscape buffer along the Chapel Hill Country Club property shall be reviewed and approved by the Community Design Commission prior to the issuance of a Zoning Compliance Permit.

 

3.      Added Stipulations:  That the below stipulations shall be added to the Resolution:

 

Pedestrian Path along Southern and Eastern Property Line:  That prior to issuance of the first Certificate of Occupancy, the applicant or Homeowners’ Association shall construct a 3 foot wide permanent surface improved footpath, or alternate path as approved by the Town Manager, along the southern and eastern property line. That the construction of the path involve minimal land disturbance.  That the final location and design of the path shall be approved by the Town Manager prior to issuance of a Zoning Compliance Permit.

 

On-site Recreation Area:  That the applicant shall provide 7,197 square feet of the 16,591 square feet of required recreation area as part of the subdivision proposal.  This on-site recreation area shall include the Homeowners’ Association land with the pedestrian pathways.  The remainder of the recreation area shall be provided as a payment-in-lieu.

 

Payment-in-Lieu for a portion of Recreation Requirements:  That the applicant provide a payment-in-lieu of providing a minimum of 9,394 square feet of recreation area for this development. The payment amount shall be reviewed and approved by the Town Manager in accordance with the Land Use Management Ordinance, Section 5.5.2.  The recreation payment amount shall be submitted to the Town prior to recordation of the final plat.

 

BE IT FURTHER RESOLVED by the Council of the Town of Chapel Hill that the Council hereby approves the application for a Preliminary Plat for the Fairway Hill Subdivision in accordance with the plans and conditions listed above.
