(Approving Application)
A RESOLUTION APPROVING AN APPLICATION FOR A SPECIAL USE PERMIT MODIFICATION FOR THE CHAPEL HILL BIBLE CHURCH PARK/RIDE TERMINAL (2006-12-04/R-17d)
BE IT RESOLVED by the Council of the Town of Chapel Hill that it finds that the Special Use Permit Modification application proposed by the University of North Carolina at Chapel Hill for the Chapel Hill Bible Church Park/Ride Terminal on property identified as Orange County Parcel Identification Number 9890-51-8534 if developed according to the site plans dated July 6, 2006, and the conditions listed below:
1. Be located, designed, and proposed to be operated so as to maintain or promote the public health, safety, and general welfare;
2. Comply with all required regulations and standards of the Land Use Management Ordinance;
3. Be located, designed, and proposed to be operated so as to maintain or enhance the value of contiguous property; and
4. Conform with the general plans for the physical development of the Town as embodied in the Land Use Management Ordinance and in the Comprehensive Plan.
BE IT FURTHER RESOLVED that the Town Council hereby approves the application for a Special Use Permit Modification for the Chapel Hill Bible Church Park/Ride Terminal in accordance with the plans listed above and with the conditions listed below:
1. Resolution A: That all of the stipulations in Resolution A shall apply to the proposed development unless modified or superseded by those stipulations below.
2. Added Stipulations: That the below stipulations shall be added to the Resolution:
Bus Shelter: That the proposed bus shelter on Old Sterling Drive be resized to provide a larger bus shelter than those currently existing on Old Sterling Drive and be located outside the right-of-way.
Bus Stop Shelter: That prior to the use as a Park/Ride Terminal, the applicant shall provide a bus shelter to comply with Section 6.8 of the Land Use Management Ordinance. That the design and location of the bus shelter shall be reviewed and approved by the Town Manager prior to the issuance of a Zoning Compliance Permit.
Sage Road Recessed Bus Pull-off: That the Sage Road bus stop include a recessed bus pull-off on Sage Road.
Lighting to Bus Stops/Shelters: That a lighting plan include pedestrian lighting to the bus stops/shelters for pedestrian safety.
Parking Lot Crosswalk: That prior to the use of as a Park/Ride Terminal, the applicant shall install a crosswalk to provide pedestrian access from the parking lot to the sidewalk along the entrance drive to Old Sterling Drive. That the final design and location of the crosswalk shall be reviewed and approved by the Town Manager prior to issuance of a Zoning Compliance Permit.
Traffic Study: That if the Council determines that an additional Traffic Study is needed, that the study includes Eastowne Drive.
Bicycle Parking: That the development shall provide a minimum of three additional bicycle parking spaces and comply with the Town’s Design Manual for bicycle parking design. That the bicycle parking shall be cover and illuminated and that the location of the existing rack be reviewed and approved, prior to the issuance of a Zoning Compliance Permit. This improvement shall be installed prior to use as a Park/Ride Terminal.
3. Deleted Stipulations: That the below stipulations shall be deleted from the Resolution:
Old Sterling Drive/Sage Road Intersection Improvements: That prior to the use as a Park/Ride Terminal, the applicant shall provide pavement markings on Old Sterling Drive at the Sage Road intersection to provide a left turn with approximately 100 feet of storage and a combination through and right turn lane.
Sage Road Bus Stop Shelter: That if the Park/Ride express bus is routed along Sage Road, that prior to the use as a Park/Ride Terminal, the applicant shall provide a large bus shelter to comply with Section 6.8 of the Land Use Management Ordinance at the end of the existing walkway from the Chapel Hill Bible Church. That the design and location of the bus shelter shall be reviewed and approved by the Town Manager prior to the issuance of a Zoning Compliance Permit.
Accessory Use Expiration: That this accessory use is approved for a time period of five years from the issuance of a Zoning Compliance Permit.
Bicycle Parking: That the development shall provide a minimum of 25 Class II bicycle parking spaces. That the bicycle parking shall be reviewed and approved by the Town Manager, prior to the issuance of a Zoning Compliance Permit. This improvement shall be installed prior to use as a Park/Ride Terminal.
BE IT FURTHER RESOLVED by the Council of the Town of Chapel Hill that the Council hereby approves the application for the Special Use Permit Modification application for the Chapel Hill Bible Church Park/Ride Terminal in accordance with the plans and conditions listed above.
