INTRODUCTION

 

Tonight, the Council continues the Public Hearing from October 18, 2006, regarding 1) an application for a text amendment to Section 3.5 of the Land Use Management Ordinance, 2) a request for a partial revocation of the Chapel Hill North Phase I Special Use Permit, and 3) an application for a Phase II Special Use Permit. The purpose of this cover memorandum is to forward the Town Manager’s Recommendation to the Council for the above request and applications.

 

The Phase II Special Use Permit application cannot be approved without prior Council approval of the application for a text amendment to Section 3.5 of the Land Use Management Ordinance and a request for a partial revocation of the Chapel Hill North Phase I Special Use Permit.

 

MANAGER’S RECOMMEDATION

 

The Town Manger has reviewed and discussed the key issues with Town staff. Based on the information in the record to date, we believe that the Council could make the findings required to approve 1) the application for a text amendment to Section 3.5 of the Land Use Management Ordinance, 2) the request for a partial revocation of the Chapel Hill North Phase I Special Use Permit, and 3) the application for a Phase II Special Use Permit.

 

The Town Manager’s Recommendation is that the Council 1) enact the ordinance to amend the text of Subsections 3.5.1(e)(2) and 3.5.1(e)(3)(A-E) of the Land Use Management Ordinance, changing the uses and ratios of uses permitted in the Mixed Use-Office/Institutional-1 (MU-OI-1) zoning district, 2) adopt Resolution A, approving the request for a Partial Revocation of the Chapel Hill North Phase I Special Use Permit with conditions, 3) adopt Revised Resolution B, approving the Phase II Special Use Permit application with conditions.
