(Denying MU-V Rezoning)

 

A RESOLUTION DENYING AN APPLICATION FOR A ZONING ATLAS AMENDMENT FOR THE UNIVERSITY VILLAGE DEVELOPMENT (Orange County Property Identifier Numbers 9798-34-3837, 9798-35-0079, 9798-54-7612)

 

WHEREAS, the Council of the Town of Chapel Hill has considered the application of East West Partners, to amend the Zoning Atlas to rezone property described below from Community Commercial (CC) to Mixed Use-Village (MU-V) zoning, and fails to find that the amendment:

  1. corrects a manifest error in the chapter; or
  2. is justified because of changed or changing conditions in the area of the rezoning site or the community in general; or
  3. achieves the purposes of the Comprehensive Plan.

 

For the reasons that:

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby denies the application of East West Partners to amend the Zoning Atlas to rezone the property identified as now or formerly Orange County Parcel Identifier Numbers 9798-34-3837, 9798-35-0079, 9798-54-7612, located at 1310 Raleigh Road and 1001 South Hamilton Road, from Community Commercial (CC) to Mixed Use-Village (MU-V) zoning. The description of the entire property is as indicated on the attached map and further described as Tract B and Tract C as recorded in Orange County Plat Book 59, Page 5.
