Excerpt from the Chapel Hill Town Charter: 

 

Chapter V, Article, 6, Sec. 5.33. Tree protection regulations.

(a)   The town is authorized to adopt ordinances after holding of a public hearing thereon, to regulate planting, removal, and substantial destruction of trees and shrubs and their surrounding soils, to the extent that the root systems of trees and shrubs extend into such soils on public and private property within the town and its extraterritorial planning jurisdiction in order to preserve, protect, and enhance valuable natural resources of the community, and to protect the health, safety, and welfare of its citizens.

(b)   All development and zoning ordinances of the Town of Chapel Hill enacted and all steps taken by that town to enact development and zoning ordinances prior to the effective date of this

section which would have been valid under subsection (a) of this section are hereby validated, ratified, and confirmed.
