ORDINANCE
(Rezoning to MU-V zoning)
AN ORDINANCE AMENDING THE CHAPEL HILL ZONING ATLAS FOR THE EAST 54 DEVELOPMENT (AKA UNIVERSITY VILLAGE DEVELOPMENT) (Orange County Parcel Identifier Numbers 9798-34-3837, 9798-35-0079, 9798-54-7612) (2007-02-26/O-4)
WHEREAS, the Council of the Town of Chapel Hill has considered the application of East-West Partners, to amend the Zoning Atlas to rezone property described below from Community Commercial (CC) to Mixed Use-Village (MU-V) zoning, and finds that the amendment is warranted, in order to achieve the purposes of the Comprehensive Plan;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill that the Chapel Hill Zoning Atlas be amended as follows:
SECTION I
That the site, identified as Orange County Parcel Identifier Numbers 9798-34-3837, 9798-35-0079, 9798-54-7612, that is currently zoned Community Commercial (CC) located at 1310 Raleigh Road and 1001 South Hamilton Road, including one half of the abutting right-of-ways of N.C. 54, Prestwick Road and Hamilton Road, shall be rezoned to Mixed Use-Village-Arterial. The description of the entire property is as indicated on the attached map and further described as Tract B and Tract C as recorded in Orange County Plat Book 59, Page 5.
SECTION II
That all ordinances and portions of ordinances in conflict herewith are hereby repealed.
