WHEREAS, the Town of Chapel Hill solicited formal bids on the Town website and in the Greater Diversity News on October 5th, 2006 in accordance with G.S. 143-128 for the Homestead Park Aquatics Center Project ; and
WHEREAS, three responsive bids were received and opened on November 2, 2006;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Manager to negotiate and execute a contract with the lowest responsive bidder, Resolute Building Company, in an amount not to exceed $5,238,000 for the construction of the Homestead Park Aquatics Center.
BE IT FURTHER RESOLVED by the Town Council that the Town Manager is authorized to continue value engineering negotiations with Resolute Building Company and to use any realized savings to accept add alternates in the following priority order:
BE IT FURTHER RESOLVED by the Town Council that the Town Manager is authorized to select Add Alternate items out of sequence of the Council’s preferred order only in the event that a higher rated option would exceed budget and a lower rated item would fit into the negotiated budget.
BE IT FURTHER RESOLVED by the Town Council that if, at the conclusion of the value engineering process, there are sufficient funds to add the desired add alternates and there is an additional $9,322 of available funds, the underwater lighting system will be included. If there are insufficient funds, the lights will be deducted.
BE IT FURTHER RESOLVED by the Town Council that, because this project is a large and complicated construction project the Town Manager is authorized to approve change orders up to up to a cumulative total of $530,000, but not to exceed the combined total project cost of $5,768,000 (construction cost plus contingency) without additional Council action.
