Adjustments to Town Code to Recognize new Town Center-3 Areas

The attached ordinance would modify the Town Code to apply regulations now applicable in Town Center-1 and -2 to areas now or which might be rezoned to Town Center-3.

 

BACKGROUND AND DISCUSSION

 

On February 26, 2007, the Town Council established a new Town Center-3 zoning district in the Town’s Land Use Management Ordinance.  The new zoning designation was, that same evening, applied by amendment to the Zoning Atlas, to one parcel on West Rosemary Street near the Carrboro/Chapel Hill line. 

 

Currently, two separate regulations in the Town Code are specifically made applicable to properties in the Town Center-1 and Town Center-2 zoning districts.

  1. Article XIX of Chapter 11 of the Town Code, enacted in 2002, establishes standards for pre-towing notices for private parking lots in the Town Center-1 and -2 Districts.  The purpose of this article was to help avoid the possibility of cars being towed when they were improperly parked on private property by establishing warning signage requirements on these lots.  We believe that these standards should also be applicable to properties in the Town Center zoned TC-3.
  2. Article VI of Chapter 17 of the Town Code has for many years established standards for the sale of merchandise on sidewalks in the Town Center zoning districts and other commercial zoning districts.  We believe that these same standards should be applied in Town Center-3 areas.

 

RECOMMENDATION:

 

That the Council enact the attached ordinance.
