Continuing Public Hearings on Residences at Chapel Hill North – Application for Land Use Management Ordinance Text Amendment, Request for Partial Revocation of the Chapel Hill North Phase I Special Use Permit and Application for Special Use Permit (PIN 9880-36-1885)

PURPOSE

 

Tonight, the Council continues their consideration of 1) a Land Use Management Ordinance Text Amendment Application, 2) a Request for Partial Revocation of the Chapel Hill North Phase I Special Use Permit, and 3) an Application for the Residences at Chapel Hill North Special Use Permit.

 

I recommend that the Council adopt the resolution, continuing the February 12, 2007 Public Hearings on these items to the April 11, 2007 meeting. 

BACKGROUND AND DISCUSSION

 

On February 12, 2007, the Council held combined Public Hearings on a proposed Text Amendment and a Special Use Permit application for a proposed development located east of the Harris Teeter at Chapel Hill North.  The proposed Text Amendment would modify the mixed-use section of the Land Use Management Ordinance.  The proposed Special Use Permit would authorize a 123-unit multi-family development.  The proposed Special Use Permit is dependent upon Council approval of the proposed Text Amendment.  In addition, the Council also considered a request to revoke a portion of the Chapel Hill North Phase I Special Use Permit. 

 

The Public Hearings on all items were continued to March 26, 2007. 

 

During the February 12 meeting, the Town Council formed a three-member Council Committee to discuss the applicant’s affordable housing rental program associated with the Residences at Chapel Hill North Special Use Permit.  Subsequent to the February 12th meeting, the committee members met on two separate occasions.  At the last meeting on March 19, the committee agreed that one additional meeting was in order before formally reporting back to the Council.  That meeting is scheduled for April 3, 2007.

 

Tonight, we anticipate a brief report from the committee members on some general findings and possible preliminary recommendation on the applicant’s affordable housing proposal.  Quick reports from the committee meeting are attached.   

RECOMMENDATION

 

Regarding the application for Land Use Management Ordinance Text Amendment, the request for partial revocation of the Chapel Hill North Phase I Special Use Permit and the Residences at Chapel Hill North Special Use Permit application, I recommend that the Council adopt the resolution, continuing the public hearings on all three items to the April 11, 2007 Council meeting.
