A RESOLUTION DECLARING A 1992 SIMON-DUPLEX AERIAL FIRE TRUCK AS SURPLUS PROPERTY AND AUTHORIZING AND DIRECTING THE DISPOSAL OF SAID PROPERTY IN ACCORDANCE WITH STATUTORY REQUIREMENTS (2007-04-11/R-4)

WHEREAS, Chapter 160A, Article 12 of N.C. General Statutes and Section 4-16 of the Charter of the Town of Chapel Hill authorizes the Town to dispose of surplus property; and

WHEREAS, the Town desires to dispose of a 1992 Simon-Duplex Aerial Fire Truck at an on-line public auction scheduled for Friday, April 13, through Monday, April 23 2007;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the 1992 Simon-Duplex Aerial Fire Truck is hereby declared surplus.

BE IT FURTHER RESOLVED that the Purchasing & Contracts manager of the Town of Chapel Hill shall be and is hereby authorized to dispose of this surplus personal property in accordance with statutory requirements and the following terms:

The sale shall be to the highest bidder for cash or other forms of cash equivalents acceptable to the Purchasing & Contracts manager.  The sale shall be designated final on the closing day of the auction.

This item shall be sold on an “as is” and “where is” basis and the Town makes no guarantees:  assumes no responsibility for this item.
