Public Hearing: Homestead Twin Towns Development – Zoning Atlas Amendment and Special Use Permit Planned Development-Housing Applications (File No. 9870-64-8194)

PURPOSE

 

Tonight, the Council holds a Public Hearing regarding a request for a Zoning Atlas Amendment and a Special Use Permit for a 21.5-acre site located on the south side of Homestead Road, just west of Seawell School Road.  The Zoning Atlas Amendment application proposes to rezone the site from Residential-2 (R-2) to Residential-4-Conditional.  The Special Use Permit application proposed a multi-family development as well as the subdivision of a one-acre lot on Rogers Road. 

 

Tonight’s Public Hearing has been scheduled to receive evidence in support of and in opposition to approval of the applications, as the Council determines the appropriate requirements to include as conditions of approval.  The purpose of this cover memorandum is to forward my preliminary recommendation to the Council.

 

MANAGER’S PRELIMINARY RECOMMEDATION

 

I believe that the proposed rezoning could be justified based on the finding that a rezoning would achieve the purposes of the Comprehensive Plan.  My preliminary recommendation is that the Council adopt the attached ordinance, rezoning the property from Residential-2 (R-2) to Residential-4-Conditional (R-4-C). 

 

With respect to the Special Use Permit application, I have reviewed and discussed the key issues with Town staff. Based on the information in the record to date, we believe that the Council could make the findings required to approve an application for a Special Use Permit.

 

We note that further evidence concerning these applications may be submitted at tonight’s Public Hearing.

 

Prior to approval of the Homestead Twin Town Special Use Permit application, it is necessary that the Council first take action on an accompanying Zoning Atlas Amendment. My recommendation is that the Council 1) enact an Ordinance to rezone the Homestead Road site; and 2) adopt Resolution A, approving an application for the Homestead Twin Towns Development.  The rezoning application will require a similar action by the Orange County Commissioners as the property is located in the Joint Planning Transition Area.
