A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER AN AMENDMENT TO THE LAND USE MANAGEMENT ORDINANCE TO CHANGE THE PLANNING BOARD’S EXTRATERRITORIAL PLANNING JURISDICTION MEMBERSHIP TO REFLECT POPULATION PROPORTIONALITY (2007-05-21/R-4)

WHEREAS, the composition of the Chapel Hill Planning Board is defined in the Land Use Management Ordinance as ten members with two members to reside in the Town’s extraterritorial planning jurisdiction, to be appointed by the Orange County Commissioners and one from the joint planning area; and

WHEREAS, as the Town of Chapel Hill corporate limits expand, the extraterritorial planning jurisdiction is decreasing; and

WHEREAS, N.C.G.S. 160A-362 provides that representation from the extraterritorial planning area on the Planning Board shall be proportional based on population; and

WHEREAS the Town staff is undertaking an analysis of the population of the Town and its extraterritorial planning jurisdiction to determine if changes in the current make-up of the Planning Board are appropriate based on the reduction in size of the Town’s ETJ due to annexation;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Public Hearing for 7:00 p.m. on Monday, June 18, 2007, in Chapel Hill Town Hall, to consider changes to the Land Use Management Ordinance to reduce the Planning Board’s extraterritorial planning jurisdiction membership as defined in the Land Use Management Ordinance from two members to one member;

BE IT FURTHER RESOLVED that the Council directs the Manager and Planning Department to proceed with the necessary analysis of population data and to report the results that study at the Public Hearing for the Council’s consideration. 

BE IT FURTHER RESOLVED that this matter is referred to the Planning Board for its recommendation and, in accordance with the terms of the Joint Planning Agreement, to Orange County for its comments and recommendation.
