PURPOSE

Tonight, the Council considers the enactment of an Ordinance to amend the Zoning Atlas to create a Neighborhood Conservation District for the Mason Farm/Whitehead Circle neighborhood. 

The purpose of this cover memorandum is to forward my recommendation to the Council.

MANAGER’S RECOMMENDATION

I believe creating a Neighborhood Conservation District for the Mason Farm/Whitehead Circle neighborhood is consistent with the Comprehensive Plan and the Land Use Management Ordinance.  My recommendation is that the Council enact the attached Ordinance, with reference to Plan B, approving the proposed Zoning Atlas Amendment without the Common Area to Bedroom Ratio regulation. 

I am concerned about one aspect of the proposal.  I do not recommend enactment of the Common Area to Bedroom Ratio regulation because I continue to be concerned that it may not have the intended effect on rental development and may be overly burdensome to property owners instead. After conferring with the Town Attorney, I am concerned that regulating the assignment and use of space in a structure’s interior may not be appropriate for Town zoning standards.  I am also concerned about the likelihood that the staff would not be able to administer/enforce the proposed regulation effectively. 

If the Council is interested in further study of the regulation or further discussion of any alternative proposals I recommend referring the issue to the Planning Board, Town Attorney, and staff for further review.
