DRAFT ORDINANCE
(Staff Recommendation)

AN ORDINANCE AMENDING THE CHAPEL HILL LAND USE MANAGEMENT ORDINANCE REGARDING PLANNING BOARD MEMBERSHIP 

WHEREAS, the Council of the Town of Chapel Hill has considered the proposed text amendment to the Land Use Management Ordinance regarding changes to the composition of the Planning Board to reduce the Board’s extraterritorial planning jurisdiction (ETJ) membership from two to one ETJ representative and finds that the amendment is warranted as conditions have changed regarding the ETJ population in relation to the Town corporate limit population;

NOW, THEREFORE, BE IT ORDAINED by the Council of the Town of Chapel Hill as follows:

Section 1. Subsection 8.2.1 of the Chapel Hill Land Use Management Ordinance is hereby revised to read as follows:

“8.2.1      Establishment of the Board; Qualifications

A Planning  Board, consisting of ten (10) members, is hereby established. Seven (7) Eight (8) members, appointed by the Council, shall reside within the corporate limits of Chapel Hill. Two (2) One (1) members shall reside within the Town's extraterritorial planning jurisdiction, and shall be appointed by the Orange County Board of Commissioners. One (1) member shall reside within the Town's Joint Planning Transition Area, and shall be appointed by the Orange County Board of Commissioners. Members shall serve without compensation, but may be reimbursed for actual expenses incidental to the performance of their duties within the limit of funds available to the Board.”

Section 2.  That all ordinances and portions of ordinances in conflict herewith are hereby repealed.

Section 3. That the amendments shall become effective upon enactment.
