Mayor Foy called the session to order at 9:45 p.m. Council members present were: Lauren Easthom, Sally Greene, Ed Harrison, Cam Hill, Mayor pro tem Bill Strom, Bill Thorpe and Jim Ward.
Council Member Mark Kleinschmidt was absent.
Also in attendance were: Town Manager Roger L. Stancil, Assistant Town Manager Bruce Heflin, Deputy Town Manager Flo Miller, and Town Attorney Ralph Karpinos.
Mr. Stancil proposed that the Council authorize the Manager to sign the development agreement for the downtown initiative with Ram Development Co. with an amendment. He said an amendment to the agreement had been drafted that included the following:
1) “LEED Certification” being deleted from the agreement and being replaced with the developer providing the Town with documentation from the design professional and LEED-certified professional that itemizes and scores the systems and improvements to be utilized in the project, which, in aggregate result in at least 26 LEED points. Additionally the developer would provide the Town with documentation from the design professional that the project heating ventilation and air conditioning system is designed to achieve a 20 percent improvement in energy efficiency as measured against the standard for energy efficiency established by ASHRAE.
2) The developer and Town may agree to have up to five of the public parking spaces located within the private parking unit rather than the public parking unit, in which case the developer will grant the Town an irrevocable perpetual license for owners of the Affordable Housing Units to use five of the parking spaces located in the private parking unit at no additional charge.
3) That the Town would fund clean up of the site at a cost of approximately $240,000, with the developer funding the excavation.
Following a brief discussion by Council members, Council Member Hill moved to authorize the Manager to sign the development agreement with the amendment, seconded by Council Member Thorpe. The vote was 6 to 2, with Council Members Easthom and Ward voting against.
