A RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE CONTRACTS FOR PUBLIC ART FOR THE DOWNTOWN ECONOMIC DEVELOPMENT INITIATIVE (2007-06-27/R-5)

WHEREAS, the Town of Chapel Hill and Ram Development Company entered into a development agreement on February 12, 2007 which includes a public art component for the Lot 5 project; and

WHEREAS, the development agreement contemplates that the artists, the Town, the developer’s lender, and the Public Arts Commission will enter into agreements detailing the process of providing public art for the Lot 5 project;

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council authorizes the Town Manager to negotiate and execute agreements for public art consistent with the terms of the development agreement of February 12, 2007 with Mikyoung Kim and for additional public artist commissions to be determined in consultation with Mikyoung Kim.

BE IT FURTHER RESOLVED that the agreements include provisions for Council review of the art designs prior to the approval and commencement of work.
