PURPOSE
The attached resolution would authorize the Town Manager to execute an agreement with the State to transfer ownership of a parcel of land and to grant temporary construction easements on Town-owned land along Weaver Dairy Road to the North Carolina Department of Transportation. The areas are shown on the attached maps. We recommend adoption of the attached resolution.
BACKGROUND AND DISCUSSION
Weaver Dairy Road is a State maintained roadway that is scheduled to be improved from a point approximately 300 feet west of Martin Luther King Junior Blvd. to the Erwin Road/Sage Road intersection, including turn lanes, bus pull-offs, bicycle lanes, curb& gutter, and sidewalk. This project is now in the design stage and the State is in the process of acquiring the necessary rights-of-way to construct the proposed improvements.
The attached resolution would authorize the Town Manager to grant temporary construction easements to the State on Town-owned land adjacent to Fire Station # 4 and Cedar Falls Park; and to transfer ownership to the State of a parcel of Town-owned land adjacent to the Birch Meadow Subdivision.
The land to be transferred to the State was acquired by the Town as a condition of approval for the Birch Meadow Subdivision, and it was obtained at that time with the expectation that it would be transferred to the North Carolina Department of Transportation when necessary for construction of the Weaver Dairy Road Improvement Project. This area will be combined with other dedicated right-of-way to provide for the construction of the proposed connection between existing Weaver Dairy Road and the Erwin Road/Sage Road intersection.
The proposed temporary construction easements are narrow strips of land adjacent to the fire station and park that are necessary to provide room for the roadway construction to occur. After completion of the project, the area within the temporary construction easements would be stabilized and would remain under the ownership of the Town. Since this is not a transfer of ownership in the underlying land, we do not assign a monetary value to the granting of temporary easements
RECOMMENDATION
That the Council adopt the attached resolution authorizing the Town Manager to execute an agreement with the State to transfer ownership of and to grant temporary construction easements on Town-owned land along Weaver Dairy Road to the North Carolina Department of Transportation.
