A RESOLUTION  AUTHORIZING THE TOWN MANAGER TO EXECUTE THE NECESSARY DOCUMENT(S) TO TRANSFER RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENTS TO THE STATE FOR THE CONSTRUCTION OF WEAVER DAIRY ROAD IMPROVEMENTS (2007-09-24/R-6)

WHEREAS, the Town owns certain land adjacent to Weaver Dairy Road, and land dedicated to the Town for the purpose of improvements to Weaver Dairy Road; and

WHEREAS, the Town received the land dedicated as right-of-way so that the North Carolina Department of Transportation could construct a street connection between Weaver Dairy Road and Erwin Road and it was the intention of the Town and the North Carolina Department of Transportation that said land would be transferred to the State for said roadway improvements; and

WHEREAS, the use of part of said Town owned property adjacent to Weaver Dairy Road would facilitate the construction of the Weaver Dairy Road  project: and

WHEREAS, said Town property within the temporary easements will revert to the Town after completion of the Weaver Dairy Road project; 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council herewith authorizes the Town Manager to execute the necessary documents to transfer said ownership rights and easements to the State as shown on the attached maps.
