AN ORDER CLOSING A SECTION OF ALLARD ROAD RIGHT-OF-WAY (2007-10-08/R-3)

 

WHEREAS, the Council of the Town of Chapel Hill on June 27, 2007 adopted a resolution of intent to consider closing an unimproved section of Allard Road right-of-way and a public hearing thereon was held on September 17, 2007; and

 

WHEREAS, closing this right-of-way would not be contrary to the public interest and all abutting properties would have access to and from public streets and closure of said right-of-way in question would not deprive any individual owning property in the vicinity of the right-of-way of reasonable means of ingress and egress.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council hereby adopts this order pursuant to North Carolina G.S. 160A-299, permanently closing approximately 375 feet of the Allard Road right-of-way as shown on Orange County Tax Map 7.39A.

 

BE IT FURTHER RESOLVED that said closure is subject to the reservation of blanket easements for stormwater drainage, and pedestrian/non-motorized vehicles, which shall be recorded on a plat to be provided by the parties requesting the right-of-way closure and approved by the Town of Chapel Hill Engineering Department.
