RESOLUTION B

 

A RESOLUTION CALLING A PUBLIC HEARING ON NOVEMBER 12, 2007 REGARDING OPTIONS TO CONSIDER A LAND USE MANAGEMENT ORDINANCE TEXT AMENDMENT TO CONSIDER CHANGES TO THE MIXED-USE VILLAGE ZONING DISTRICT AND TO CONSIDER REZONING SPECIFIED LOTS TO IMPLEMENT THE NORTHERN AREA TASK FORCE REPORT AND THE CHAPEL HILL NORTHERN AREA WORKSHOP TRANSIT ORIENTED DEVELOPMENT CONCEPT PLANS (2007-10-08/R-9b)

 

WHEREAS, on March 7, 2007 the Council held a work session to review development activity in the northern area of Chapel Hill; and

 

WHEREAS, on March 26, 2007 the Council created a Task Force to advise it how to better manage the future development of the area, including advice in developing recommendations for the Council’s consideration on design standards and appearance guidelines for the implementation of transit-oriented development along Martin Luther King Jr. Boulevard, Weaver Dairy Road and Eubanks Road, and advice in developing recommendations on pedestrian and bicycle safety improvements throughout the study area; and

 

WHEREAS, on May 21, 2007 the Council enacted a temporary moratorium on development in the Northern Area pending the preparation of Comprehensive Plan amendments, design guidelines and zoning solutions as they relate to Transit Oriented development and the Northern Area; and

 

WHEREAS, on September 24, 2007 the Council received and referred the Northern Area Task Force Report and Chapel Hill Northern Area Workshop: Transit Oriented Development Concept Plans, for review and comment, to the Planning Board, the Transportation Board, the Bicycle and Pedestrian Advisory Board, and the Community Design Commission, and the Town Manager and Attorney; and

 

WHEREAS, on October 8, 2007 the Council considered options, as possible implementation actions required to conclude the Northern Area moratorium and to implement the Northern Area Task Force recommendations, as well as the associated Transit Oriented Development Concept Plans.

 

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Public Hearing on November 12, 2007 to consider rezoning specific lots from Mixed Use-Office/Institutional-1 (MU-OI-1) to Mixed Use-Village (MU-V), including lots identified as Orange County Parcel Identifier Numbers 9880-08-4202, 9870-88-7284, 9880-36-9150, 9880-36-6173, 9880-36-8223, 9880-36-4239, 9880-36-5077, 9880-36-3057, 9880-36-3122, 9880-35-2934, 9880-35-6911, 9880-35-3993, 9880-35-6747, 9880-35-4739, 9880-35-2871, 9880-35-0595, 9880-24-8576, 9880-25-8495, 9880-25-9324, 9880-35-0055, 9880-34-1963, 9880-24-9982, and 9880-56-2680, as identified in Attachments 3 and 4.

 

BE IT FURTHER RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Public Hearing on November 12, 2007 to consider text amendments to the Land Use Management Ordinance to introduce uses by right in the Mixed Use-Village (MU-V) zoning district, including allowing mixed-use development as a right, with approval by the Planning Board for development with less than 20,000 square feet of floor area or 40,000 square feet of land disturbance, and that single-family homes continue to be a use by right, with approval authorized by staff, as in the MU-OI-1 zoning district. 

 

BE IT FURTHER RESOLVED that the Council directs the Manager to proceed with the necessary analysis of rezoning the specific lots and to report the results of that analysis at the Public Hearing for the Council’s consideration; and

 

BE IT FURTHER RESOLVED by the Council of the Town of Chapel Hill that rezoning proposals are hereby referred to the Planning Board for their recommendations.
