Municipal Agreement for Bicycle and Pedestrian Improvements to Old Durham Chapel Hill Road

PURPOSE

The attached resolution would approve a municipal agreement (Attachment 1) to construct bicycle and pedestrian facilities along Old Durham Chapel Hill Road and authorize the Town Manager to sign and execute the agreement with the Department of Transportation and the City of Durham.

BACKGROUND

The Town of Chapel Hill and the City of Durham have jointly planned for the construction of bicycle and pedestrian facilities along Old Durham Chapel Hill Road.

In 2004, the Durham-Chapel Hill-Carrboro Transportation Advisory Committee of the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization initiated the development of the Old Durham-Chapel Hill Road Bicycle and Pedestrian Feasibility Study. This study reviewed options for providing bicycle and pedestrian facilities along Old Durham-Chapel Hill Road from U.S. 15-501 Boulevard in Chapel Hill to Garrett Road in Durham (approximately 2.7 miles). Attachment 2 (Study Area Map).

On September 19, 2005, the Town Council held a Public Forum for citizen comment on the Draft Bicycle and Pedestrian Corridor Study for Old Durham Chapel Hill Road.

On October 10, 2005 Council adopted a resolution endorsing the recommendations for bicycle and pedestrian improvements described in the Draft Facilities Study for Old Durham Chapel-Hill Road and expressing a preference for implementation Option 1. At that time only partial funding was available to complete a first phase of the project. The resolution also recommended that the Durham-Chapel-Hill-Carrboro Transportation Advisory Committee seek additional funds for the project.

DISCUSSION

The Town of Chapel Hill and the City of Durham have jointly pursued funding for this project from the North Carolina Department of Transportation. The total project cost is estimated at $3.83 million. The North Carolina Department of Transportation has allocated $400,000 in Surface Transportation Program (STP-EB) funds, plus an additional $2,742,400 from the Durham-Chapel Hill-Carrboro (DCHC) Metropolitan Planning Organization’s (MPO) Surface Transportation Program Direct Attributable Funds allocation.  The $2,742,400 represents 80% of the $3,428,000 estimated amount that will be required for the subject Project from STP-DA funds. 

Under the terms of the Municipal Agreement the Municipalities are responsible for providing the 20% matching funds, (estimated at $685,600) for the Direct Attributable Funds authorized. The Municipalities shall be responsible for funding the 20% match ($685,600) for the Direct Attributable Funds authorized, The Durham share of the 20% match is estimated to be $445,640.  The Chapel Hill share of the 20% match is estimated to be $239,960.

Chapel Hill 2003 bond funds are available and can be used to provide the Town’s share of the 20 % local match required for the Surface Transportation Program Direct Allocation funds. Phased payments would be made in 2007, 2008 and 2009.

Construction is scheduled for 2008-2009.

RECOMMENDATION

That the Council adopt the attached resolution approving the municipal agreement to construct bicycle and pedestrian facilities along Old Durham Chapel Hill Road and to authorize the Town Manager to sign and execute the agreement with the Department of Transportation. That Chapel Hill bond funds are used to provide the Town’s share of the 20 % local match required for the Surface Transportation Program Direct Allocation funds.
