(Preliminary Recommendation - Rezoning to MU-V Zoning District)
AN
ORDINANCE AMENDING THE CHAPEL HILL ZONING ATLAS FOR THE NORTHERN AREA TO REZONE
PROPERTY TO THE MIXED USE-VILLAGE ZONING DISTRICT (Orange County Parcel Identifier
Numbers 9880-08-4202, 9870-88-7284, 9880-56-2680, 9880-36-9150, 9880-36-6173,
9880-36-8223, 9880-36-4239, 9880-36-5077, 9880-36-3057, 9880-36-3122,
9880-35-2934, 9880-35-6911, 9880-35-3993, 9880-35-6747, 9880-35-4739,
9880-35-2871, 9880-35-0595, 9880-24-8576, 9880-25-8495, 9880-25-9324,
9880-35-0055, 9880-34-1963 and 9880-24-9982.
WHEREAS, the Council of the Town of Chapel Hill has
considered the proposal to amend the Zoning Atlas to rezone subject areas described
below from Mixed Use-Office/Institutional-1 (MU-OI-1) to the Mixed Use-Village
(MU-V) zoning district, and finds that the amendments are warranted, in order
to address changed or changing conditions in the areas of increasing
development activity and that the amendments are warranted to achieve the
purposes of the Comprehensive Plan, including the transit-oriented development
objectives of the Final Report of the Chapel Hill Northern Area Task Force as
well as the associated Transit Oriented Development Concept Plans;
NOW, THEREFORE, BE IT ORDAINED
by the Council of the Town of Chapel Hill that the Chapel Hill Zoning Atlas be
amended as follows:
SECTION I
That the subject areas, which are currently zoned Mixed
Use-Office/Institutional-1 (MU-OI-1), including:
- Area 1, identified as Orange County Parcel Identifier Numbers 9880-08-4202
and 9870-88-7284, located on an approximately 36.76-acre (1,601,055 square
feet), two-lot assemblage, on the north side of Eubanks Road between Rex Road
and Route NC-86, including any portion of the abutting right-of-way on Eubanks
Road that is within Chapel Hill Corporate Limits, shall be rezoned Mixed
Use-Office/Institutional-1 (MU-OI-1) to the Mixed Use-Village (MU-V) zoning
district (see attached map);
- Area 2, identified as Orange County Parcel Identifier Numbers 9880-56-2680,
9880-36-9150, 9880-36-6173, 9880-36-8223, 9880-36-4239, 9880-36-5077,
9880-36-3057, 9880-36-3122, 9880-35-2934, 9880-35-6911, 9880-35-3993,
9880-35-6747, 9880-35-4739, and 9880-35-2871, located on an approximately
34.8-acre (1,515,888 square feet), seven-lot assemblage, on the north side of
Weaver Dairy Road between Kingston Drive and Perkins Drive, including one-half
of the abutting rights-of-way on Weaver Dairy Road and Perkins Drive, shall be
rezoned Mixed Use-Office/Institutional-1 (MU-OI-1) to the Mixed Use-Village
(MU-V) zoning district (see attached map);and
- Area 3, identified as Orange County Parcel Identifier Numbers 9880-35-0595,
9880-24-8576, 9880-25-8495, 9880-25-9324, 9880-35-0055, 9880-34-1963 and
9880-24-9982, located on an approximately 7.7-acre (335,412 square feet), eight-lot
assemblage, located southeast of the intersection of Weaver Dairy Road and
Martin Luther King, Jr. Blvd., including one-half of the abutting rights-of-way
on Weaver Dairy Road, Martin Luther King Jr. Blvd., and Westminster Drive, shall
be rezoned Mixed Use-Office/Institutional-1 (MU-OI-1) to the Mixed Use-Village
(MU-V) zoning district (see attached map).
SECTION II
That
all ordinances and portions of ordinances in conflict herewith are hereby
repealed.
