A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER EXTENDING THE DEVELOPMENT MORATORIUM OF THE NORTHERN AREA OF CHAPEL HILL (2007-11-19/R-13)

 

WHEREAS, on March 7, 2007, the Council of the Town of Chapel Hill, held a work session to review development activity in the north and northwest areas of Chapel Hill; and

 

WHEREAS, on March 26, 2007, the Council adopted a resolution calling a Public Hearing for May 7, 2007, to consider a development moratorium of an area, as shown on a map labeled as Attachment 2 of a memorandum to Town Council of March 26, 2007, excluding the Joint Planning Transition Area; and,

 

WHEREAS, the Council conducted that hearing on May 7, 2007, and continued the hearing until May 23; and,

 

WHEREAS, following that hearing the Council enacted a temporary development ordinance on the development on the area shown on the map referenced above; and,

 

WHEREAS, said development moratorium is set to expire on January 31, 2008; and,

 

WHEREAS, on November 12, 2007, the Council conducted a public hearing to consider recommendations for changes to the Comprehensive Plan and amendments to the Town’s Land Use Management Ordinance and Zoning Atlas to address issues raised by the Northern Area Task Force Final Report which was prepared during the time of the moratorium; and,

 

WHEREAS, on November 12, 2007, the Council requested that an option be provided to the Council to consider the possible extension of the temporary development ordinance beyond its scheduled January 31, 2008 termination date

 

 NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Council calls a Public Hearing for January 14, 2008 at 7:00 p.m. in the Council Chamber, Town Hall, 405 Martin Luther King Jr. Boulevard, to consider an extension of the development moratorium enacted on May 21, 2007 of the area, as shown on a map labeled as Attachment 2 of a memorandum to Town Council of March 26, 2007, excluding the Joint Planning Transition Area and directs that this matter be referred to the Planning Board for its recommendation and that the notice for said possible moratorium extension be provided in accordance with the provisions of N.C. G.S. 160A-381(e).
