SUMMARY MINUTES OF A CLOSED SESSION

OF THE CHAPEL HILL TOWN COUNCIL

WEDNESDAY, NOVEMBER 7, 2007

 

The Mayor called the closed session to order at 9:00 p.m.

 

Attending:  Mayor Foy; Council Members Easthom, Greene, Harrison, Hill, Kleinschmidt, Strom, Thorpe, and Ward; Town Manager Stancil; and Town Attorney Karpinos. 

 

Ralph Karpinos reviewed the status of the Rayfield v. Town of Chapel Hill case and the status of the negotiations to settle the case since the Council last considered this matter on October 22.  At that meeting the Council had voted to offer to reduce the required payment in lieu by $15,000 but not to accept any change in the other terms of the subdivision regarding road alignment.

 

Mr. Karpinos reported that the Plaintiff had responded by offering a payment in lieu of $45,000 and saying he would accept the other terms of the subdivision approval regarding location of the roadway.

The Council by consensus agreed to authorize the Attorney to propose that the parties split the difference between $45,000 and the Town’s earlier offer and that the Town would accept a payment in lieu in the amount of $53,616.

 

The Closed Session ended and the meeting was adjourned at 9:10 p.m.
