Subject:            Land Use Management Ordinance (LUMO) Text Amendments:

Ordinance A – Higher Density Zoning Districts

Ordinance B – RCD Floor Area

 

Thank you for the opportunity to provide comment.

 

With respect to the proposed Ordinance B – I do not support the change that would “allow floor area to be transferred from the environmentally sensitive portion of the property to the buildable portion of the property rather than penalize properties that have some portion in the RCD…”

 

I think that there are current mechanisms in place for developers to request zone density changes.  I think these can be evaluated by the Town on a case-by-case basis.

 

Changing the text sends the message to developers that high-density is being encouraged, regardless of location of RCD and regardless of impact on the RCD.

 

I disagree that there will be no negative impact on the RCD.  How do you know?    Higher density adjacent to the RCD will impact surface area, trees, drainage, and water usage.

 

This situation is what prompted me to go to the Town Planners earlier this year because of the high density neighborhood proposed by the developer who purchased the land adjacent to our neighborhood (and which includes an RCD)).  The Meadows’ Board has asked me and my neighbors adjacent to the proposed development to represent the Board at the Town and with the developer.  Please see comments from 5 Feb 2008 Town Planning meeting.

 

I do not think the RCD should be penalized for being located within a property.  And I do not think neighbors adjacent to a property that contains an RCD should be penalized.
