subject:       Public Hearing: Residences at Grove Park, 425 Hillsborough Street, Zoning Text Amendment, Zoning Atlas Amendment and Special Use Permit Applications

PURPOSE

Tonight, the Council holds public hearings regarding requests from Ram Development Company for a Zoning Text Amendment, Zoning Atlas Amendment and a Special Use Permit for Residences at Grove Park. Tonight’s public hearings have been scheduled to receive evidence in support of and in opposition to approval of the applications. The purpose of this cover memorandum is to forward my preliminary recommendation to the Council.

MAnager’s preliminary recommendation

Zoning Atlas Amendment – Conditional Rezoning: Based on the information in the record to date, I believe the Council could make the findings required to amend the Zoning Atlas. My recommendation is that the Council enact the attached Ordinance rezoning from Residential-4 and Residential-6 to Residential-Higher Density 3-Conditional if the Land Use Management Text Amendment regarding Higher Density Residential Zoning Districts and Resource Conservation District Floor Area Ratios is enacted.

Special Use Permit: I have reviewed and discussed the key issues with Town staff. Based on the information in the record to date, we believe that with the conditions in the attached Resolution and the modification to the regulations requested by the applicant, the Council could make findings required to approve an application for a Special Use Permit. My recommendation is that the Council adopt Resolution A, approving an application for the Special Use Permit, if the rezoning application is approved.
